An individual, corporation, or an employee of a corporation, who, in good faith and at the request of the Department of Public Health, provides emergency care to a victim of a public health emergency, will not be held legally responsible for acting or failing to act. They can be held legally responsible if acting with extreme carelessness. This section does not apply if the person, corporation, or employee of the corporation was the cause, in part or whole, of the public health emergency.

Good Samaritan Law: Respiratory Care Practitioner

A respiratory care practitioner, who, in good faith, provides care at the scene of an emergency, will not be held legally responsible for acting or failing to act. They can be held legally responsible if acting with extreme carelessness. Generally, Good Samaritan laws only offer protection for those individuals who provide care during spontaneous emergencies unrelated to volunteer deployment.

A physician, physician's designee, advanced registered nurse practitioner, or physician assistant who, directly or via communication equipment, gives orders to an emergency medical provider, registered nurse, or licensed practical nurse at the scene of an emergency will not be held legally responsible for acting or failing to act. They can be held legally responsible if acting with extreme carelessness.

A certified emergency medical care provider, registered nurse, licensed practical nurse, or physician assistant who provides emergency medical under the supervision of a physician will not be held legally responsible for acting or failing to act. An individual, who, in good faith, provides aid under the intrastate mutual aid system, will be considered an agent of the requesting political subdivision and will not be held legally responsible for acting or failing to act. This section is limited to the intrastate mutual aid system.

An individual who prescribes or a first responder who, in good faith, administers or provides an opioid antagonist will not be held legally responsible for acting or failing to act.

Dentist,

A retired dentist or dental hygienist can apply for a retired volunteer dental license. A dentist or dental hygienist holding a retired volunteer license cannot accept compensation for their practice of dentistry. A volunteer license is not required for a currently licensed dentist or dental hygienist to volunteer their time.

When an emergency declaration is in effect, a licensed physician assistant, who, voluntarily and without compensation, responds to the need for medical care, can provide their services without following supervision requirements but with such supervision as is available. A physician who supervises a physician assistant who provides medical care in response to an emergency is not required to follow supervision requirements.

An individual, who holds a license, certificate, or permit for professional, mechanical, or other skills issued by Iowa or by a responding entity, is considered to be licensed, certified, or permitted in the requesting jurisdiction for the duration of the emergency. This section is limited to the intrastate mutual aid system.

License Reciprocity: Fire Protection System Installer or Maintenance Worker

When an emergency declaration is in effect, the state fire marshal can issue temporary licenses to fire protection system installers and maintenance workers who are currently licensed in another state. This license will only be valid for 90 days.

A public or private employer cannot terminate an employee who is a volunteer emergency services provider for joining such services or when, with written notification, they are absent due to fulfilling such duties. The employer can request written notification from the volunteer's supervisor for any absent time and deduct from the employee's regular pay for the time absent while fulfilling their duties. An employer can determine if an employee can leave work early for their volunteer duties. The employee must notify the employer as soon as possible for any absence.

A volunteer firefighter, emergency medical personnel, or a reserve peace officer, who is injured or killed while performing their duties, is entitled to workers' compensation.

A requesting entity must provide workers' compensation for employees and volunteers when providing intrastate assistance to another jurisdiction. An employee of the responding entity must receive the same workers' compensation during the emergency as they would receive from their employer. This section is limited to the intrastate mutual aid system.

A public employee, who is a certified disaster service volunteer of the American Red Cross, is entitled to leave with regular pay and without loss to seniority, vacation time, compensatory time, personal days, sick time, or earned overtime accumulation to participate in disaster relief operations upon request of the American Red Cross and with approval from employee's supervisor. This leave will be granted for disasters within Iowa. An employee on this leave will not be considered a state employee for purposes of workers' compensation or tort claims. This is limited to 15 work days in a 12 month period either consecutively or nonconsecutively .

An employee of Iowa, who is a volunteer firefighter or emergency medical service personnel, is entitled to leave for the period of an emergency response without loss to status, pay, sick time, or other employment benefit.
