Liability: Food Donation
An individual who donates food apparently fit for human consumption will not be held legally responsible for the condition of the food. They can be held legally responsible if acting with extreme carelessness or intent to cause harm.
Immunity for Donated Food
Any person, corporation, partnership, association or other organization which donates food or any donee which receives or serves donated food shall not be liable for damages in any civil or criminal action for any injury or death because of the condition of the food, unless the injury or death is a direct result of the gross negligence or wanton act or omissions of the donor or the donee.
