Liability: Hazardous Materials Discharge
An individual who, voluntarily or at the request of the Department of Planning and Natural Resources, provides assistance in preventing or cleaning up a discharge of oil or other hazardous materials will not be held legally responsible for acting or failing to act. They can be held legally responsible if acting with extreme carelessness or intent to cause harm.
Removal of prohibited discharges
(4) No person who, voluntarily or at the request of the Department or its designee, renders assistance in containing or removing oil or other pollutants shall be liable for any civil damages to their parties resulting solely from acts or omissions of such person in rendering such assistance, except for acts or omissions amounting to gross negligence or willful misconduct.
