Summary Title

Good Samaritan Law: Nurse

Summary

A licensed nurse who, in good faith, provides emergency care at the scene of an emergency which occurs outside the nurse's employment will not be held legally responsible for acting or failing to act. They can be held legally responsible if acting with extreme carelessness. Generally, Good Samaritan laws only offer protection for those individuals who provide care during spontaneous emergencies unrelated to volunteer deployment.

A person licensed under this chapter who in good faith renders emergency care at the scene of an emergency which occurs outside both the place and the course of that person's employment shall not be liable for any civil damages as the result of acts or omissions by that person in rendering the emergency care. This section shall not grant immunity from civil damages when the person is grossly negligent.
