Liability: Collection of Food for Needy
An individual who allows others to collect from the individual’s fields for distribution to the needy will not be held legally responsible for any injury or death to the people collecting from the property. They can be held legally responsible if acting with extreme carelessness or intent to cause harm.
Liability for Damages from Donated Food
(b) A person who is allowing his or her fields to be gleaned by volunteers for distribution to the needy is not subject to civil or criminal liability that arises due to the injury of a gleaner, unless an injury or death results from an act or omission of the person constituting gross negligence, recklessness, or intentional misconduct.
