Liability: Law Enforcement Responding to Mutual Aid Request
A law enforcement officer who responds to a request for mutual aid within South Dakota will not be held legally responsible. They can be held legally responsible if acting with extreme carelessness or intent to cause harm
No civil liability except for acts of willful misconduct or gross negligence — No waiver of immunity
No person or public agency or covered entity may be held civilly liable for actions in requesting or providing assistance under this chapter except for acts of willful misconduct or gross negligence. Nothing in this chapter constitutes a waiver or abrogation of sovereign immunity or any statutory immunity.
