Liability: Advanced Practice Nurse
A licensed advanced practice nurse who, in good faith and without compensation, provides emergency care will not be held legally responsible for acting or failing to act. They can be held legally responsible if acting with extreme carelessness or intent to cause harm.
Advanced practice nurse; exemption from civil liability for emergency care
A person licensed as an advanced practice nurse under the Nurse Practice Act [225 ILCS 65/50-1 et seq.] who in good faith provides emergency care without fee to a person shall not be liable for civil damages as a result of his or her acts or omissions, except for willful or wanton misconduct on the part of the person in providing the care.
