Liability: Volunteer Medical Direction by Physician
A licensed physician, who, without compensation, provides medical direction concerning emergency medical services within the scope of their license, will not be held legally responsible for acting or failing to act. They can be held legally responsible if acting with extreme carelessness or intent to cause harm.
Immunity of physician licensed under IC 25-22.5 for providing medical direction concerning emergency medical services.
Except as provided in section 2 [IC 34-30-13-2] of this chapter, a physician licensed under IC 25-22.5 is immune from civil liability resulting from an act or omission related to the provision of medical direction concerning emergency medical services (as defined in IC 16-18-2-110) within the scope of the physician’s license, if the physician provides medical direction concerning emergency medical services: (1) to a person who is certified under IC 16-31 to provide the emergency medical services; and (2) without compensation.
