Workers' Compensation: Hazardous Material Response Team

Summary

A member of a hazardous material response team will be considered a public employee and is entitled to workers' compensation if they are injured or killed while performing their duties.

For the purposes of workers compensation coverage, each member of each emergency response team shall at all times be considered an employee of the public or nonpublic entity contracting with the state fire marshal to provide emergency response team services.
